Terms of Service

You must be at least 13 years old (or 16 in the European Union) to use the Service. By creating an account, you represent that you meet this age requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and consented to these Terms on your behalf.

You may not use the Service if you have previously been banned or removed by ExamSaver, or if applicable law prohibits you from receiving the Service.

• You must provide accurate, complete, and current information when creating your account.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• Usernames must be 3–20 characters, may only contain lowercase letters, numbers, and underscores, and must not impersonate another person or brand.
• You must notify us immediately at support@examsaverapp.com if you suspect unauthorised access to your account.
• You may not share your account credentials or allow others to access your account.
• We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Upload, share, or transmit any content that is illegal, defamatory, obscene, hateful, or infringes any third-party intellectual property rights.
• Use the Service to harass, bully, or intimidate other users.
• Attempt to gain unauthorised access to any part of the Service, our servers, or any connected systems.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Use automated tools (bots, scrapers, crawlers) to access the Service without our written consent.
• Upload malware, viruses, or any code designed to damage or disrupt systems.
• Circumvent or attempt to circumvent any rate limits, usage quotas, or subscription restrictions.
• Use the Service to generate or disseminate misinformation, spam, or misleading content at scale.
• Use the Service in any way that could harm ExamSaver, our users, or third parties.

We reserve the right to investigate violations and take appropriate action, including content removal, account suspension, and referral to law enforcement.

The Service, including its design, software, AI models, branding, and all content created by ExamSaver, is owned by ExamSaver and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use the ExamSaver name, logo, or branding without our prior written consent.

You may not copy, distribute, modify, or create derivative works of any part of the Service without our explicit permission.

ExamSaver includes social features such as following other users, shared leaderboards, multiplayer challenges, and public competitions. When using these features:

• Treat other users with respect. Harassment, hate speech, or abusive behaviour will result in account suspension.
• Do not cheat in challenges or competitions (e.g., using answer-lookup tools, colluding with opponents).
• Do not share another user's personal information without their consent.
• Study sets you choose to share publicly may be viewed and used by other ExamSaver users.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

The Service integrates with third-party providers including Google Firebase, Supabase, and payment processors. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated study content will be accurate or complete. You use AI-generated content at your own risk and should always verify important information from authoritative sources.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUIZIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL QUIZIFY'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO QUIZIFY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED NAIRA (₦100).

You agree to indemnify, defend, and hold harmless ExamSaver and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right.

We may revise these Terms at any time. We will provide at least 14 days' notice of material changes via in-app notification or email. If you continue to use the Service after changes take effect, you accept the revised Terms. If you do not agree, you may close your account before the changes take effect.

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any dispute arising out of these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Nigeria.

Before initiating formal proceedings, you agree to first contact us at support@examsaverapp.com and attempt to resolve the dispute informally within 30 days.
